Le droit de transformation de l’assurance collective: un incontournable

Il existe une clause en assurance qui permet de transformer son assurance vie collective en assurance vie individuelle: c’est le droit de transformation. Grâce à ce droit, les employés ont le privilège de transformer leur assurance vie collective en assurance vie individuelle au moment de leur cessation d’emploi ou de la résiliation de la police.

Bref, lorsqu’il y a cessation d’emploi pour quelque raison que ce soit et que l’employé en question souscrivait une assurance collective, celui-ci a un droit de transformation s’il soumet sa demande dans les trente (30) jours suivant la cessation d’emploi. Dans ce cas, la compagnie d’assurance a l’obligation de fournir une assurance vie à l’employé qui cesse ses fonctions, quel que soit son état de santé. Il est à noter qu’en cas de transformation, le choix de produits individuels est souvent restreint; généralement, il s’agit d’une assurance de type permanent ou vie entière qui comporte des valeurs de rachat garanties et une prime légèrement supérieure à la moyenne. Le montant d’assurance offert doit être égal au montant de la couverture collective qui prend fin. Toutefois, l’assuré peut demander une couverture inférieure. La prime de cette assurance sera calculée en fonction de l’âge de l’individu au moment de la demande, conformément à la table de tarification standard, c’est-à-dire «fumeur».

Lorsqu’il y a résiliation de la police, c’est-à-dire lorsque l’employeur met fin à son assurance collective avec sa compagnie d’assurance, le droit de transformation s’applique en vertu des mêmes règles. Cette disposition est aussi vraie lorsque l’employeur décide de laisser tomber une protection particulière. Dans le cas qui nous intéresse, le droit de transformation serait applicable si un employeur annulait l’assurance vie, mais conservait les autres protections. Par contre, un changement d’assureur ne donne pas de droit de transformation, même s’il y a modification à la baisse – mais maintien – des protections.

Prenons l’exemple de Jean. Âgé de 28 ans, Jean est atteint de la fibrose kystique et travaille pour un grand manufacturier de sa région depuis huit mois. Jean adhère à l’assurance collective et a une protection en assurance vie correspondant à une (1) fois son salaire annuel, soit 37 000 $. Jean a pu souscrire l’assurance collective malgré son état de santé, car la compagnie d’assurance assure un groupe selon des conditions déterminées, et non un individu en particulier. Malheureusement, Jean doit quitter son emploi en raison de la détérioration de son état de santé. Il se rend donc au bureau du personnel de son employeur et s’assure de faire une demande de transformation par écrit à l’aide d’un formulaire fourni par la compagnie d’assurance. Idéalement, cette démarche est faite au moment où il quitte son emploi. À la réception de cette demande, la compagnie d’assurance contacte Jean pour lui proposer certains produits d’assurance vie et lui expliquer les modalités des contrats correspondants. Compte tenu de l’âge de Jean et de la tarification «fumeur», Jean aura le choix entre des produits d’assurance vie permanents, dont la prime pourra varier entre 35 $ et 60 $ par mois environ, pour une couverture de 37 000 $ selon le type de police qu’il choisira.
